Asylum and withholding of removal are available to people who have either been persecuted in their home countries or have a reasonable belief that they will be persecuted if returned to their home country. Typically, in order to be granted Asylum, you must file within one year of entering into the United States. Withholding of Removal does not have the same requirement, but it does differ from asylum in that Withholding of Removal recipients do not have the possibility to adjust their status to that of an LPR. Both are available to individuals who have suffered persecution based on race, gender, religion, nationality, political opinion, or membership in a particular social group.
